In compliance with Brazilian Civil Code, Consumer Protection Code and Internet Civil Framework (Law No. 12.965/2014).

1. Party Identification

Provider: StackBox Tecnologia Ltda., CNPJ No. 63.865.078/0001-99, headquartered at Tecnopuc - PUCRS Science and Technology Park, Porto Alegre/RS, Brazil ("StackBox" or "Company").
User: Individual or legal entity who accesses the website or contracts StackBox services.

2. Purpose

These Terms of Use govern access to and use of the StackBox institutional website (www.stackbox.com.br), as well as the provision of digital product consulting, UX/UI design, systems development and technology solutions services.

3. Acceptance of Terms

By accessing the website, filling out contact forms or contracting services, the User declares to have read, understood and fully accepted these Terms of Use and our Privacy Policy. If you do not agree, you must immediately cease use.

4. Services Offered

StackBox offers:

  • Digital Product Consulting: Product Discovery, Lean Inception, Design Sprint, Design Thinking.
  • UX/UI Design: User research, wireframes, prototypes, usability testing.
  • Systems Development: Front-end, Back-end, APIs, databases, mobile applications.
  • Dedicated squads: Multidisciplinary teams for ongoing projects.
  • AI Solutions: Intelligent automations and AI agents.

Specific services, scope, deadlines and prices are defined in commercial proposals and individual contracts.

5. Forms and Data Collection

When filling out contact forms on the website:

  • The User declares that the information provided is true and up to date.
  • Data will be processed in accordance with our Privacy Policy.
  • Form submission does not constitute service contracting, but only expression of interest.
  • StackBox will contact you through the provided data to follow up on the request.

6. User Obligations

The User agrees to:

  • Provide true, complete and up-to-date information;
  • Use the website lawfully, respecting applicable legislation;
  • Not engage in acts that may damage, overload or impair website operation;
  • Not attempt to access restricted areas or security systems;
  • Respect StackBox's and third parties' intellectual property rights.

7. Intellectual Property

All website content (texts, images, logos, layout, source code, trademarks) is owned by or licensed to StackBox, protected by Copyright Law (Law No. 9.610/98), Industrial Property Law (Law No. 9.279/96) and international treaties.

Reproduction, copying, distribution, modification or creation of derivative works without express written authorization is prohibited.

8. Project Intellectual Property

For contracted services:

  • Intellectual property of deliverables will be defined in each project's specific contract.
  • As a rule, after full payment, property rights of deliverables are transferred to the client.
  • StackBox's proprietary methodologies, frameworks and tools remain its property.
  • StackBox may use the project as portfolio reference, unless a confidentiality agreement exists.

9. Confidentiality

Information exchanged during negotiations and service provision is treated as confidential. Both parties commit not to disclose confidential information to third parties, except when required by law or competent authority.

10. Limitation of Liability

StackBox is not liable for:

  • Damages resulting from fortuitous events, force majeure or User's exclusive fault;
  • Temporary website unavailability due to maintenance or external factors;
  • Decisions made by User based on website information;
  • Content of linked third-party websites;
  • Specific business results, which depend on multiple external factors.

In any case, StackBox's total liability is limited to the amount actually paid by User in the 12 months preceding the event, subject to consumer rights when applicable.

11. Warranties

StackBox guarantees:

  • Service provision with diligence and professionalism;
  • Qualified and specialized team;
  • Compliance with deadlines agreed in contract;
  • Correction of defects in deliverables as per warranty defined in contract.

The website is provided "as is", without guarantees of uninterrupted availability or absence of errors.

12. Term and Termination

Website access is for an indefinite term. For contracted services, terms are defined in specific contract.

StackBox reserves the right to suspend or terminate access by Users who violate these Terms, without prejudice to applicable legal measures.

13. Modifications

These Terms may be updated at any time. Significant changes will be communicated by notice on the website. Continued use after changes implies acceptance of new terms.

14. Applicable Law and Jurisdiction

These Terms are governed by the legislation of the Federative Republic of Brazil, especially:

  • Civil Code (Law No. 10.406/2002);
  • Consumer Protection Code (Law No. 8.078/1990), when applicable;
  • Internet Civil Framework (Law No. 12.965/2014);
  • General Data Protection Law (Law No. 13.709/2018).

The courts of Porto Alegre/RS are elected to resolve any disputes, subject to consumer's right to opt for their domicile's jurisdiction.

15. Provisions for International Users

Users located outside Brazil acknowledge that:

  • StackBox is a Brazilian company, primarily subject to Brazilian legislation;
  • There may be limitations in service provision in certain jurisdictions;
  • Disputes will be resolved according to Brazilian law, parties may agree on international arbitration in specific contracts.

16. Dispute Resolution

Parties will seek to amicably resolve any conflicts. If not possible, they may opt for:

  • Mediation through recognized mediation chamber;
  • Arbitration, pursuant to Law No. 9.307/1996;
  • Judicial proceedings, in competent jurisdiction.
